Lahore: Lahore High Court (LHC) has maintained no accused can be deprived of right to fair trial in the name of public interest. Justice Tariq Salim Sheikh of LHC issued 9-page written order on the petition of the accused persons nominated in blasphemy case wherein it was ordered to provide all documents regarding evidence to the accused persons.
It was said in the decision that all the documents attached with police report are part of case. The accused should be given full access to these documents.
As per court whats app messages, forensic reports and other all evidence be provided to the accused so that they could defend them effectively.
The court further maintained just and fair trial is not possible without access to evidence. Fair trial is basic right of every accused. It was made clear in the decision that every document can not be stopped in the name of public interest. Fulfilling the norms of justice is must. The LHC while approving the petition of the accused has directed trial court all the requisite documents be provided so that the legal norms could be met.
