Islamabad:Ali Zafar, counsel for PTI founder while raising objection over constitution of bench in review case of interpretation of article 63-A of constitution has filed petition in Supreme Court (SC).Ali Zafar has taken plea bench of review case has not been constituted under section-2 of the law. According to presidential ordinance judges committee will comprise of 3 judges too. The responsibility for constitution of benches was assigned to 3 judges in law.According to text of the petition the bench can be constituted and hearing can take place after collective wisdom of judges. It is fact two instead of 3 members took part in the meeting of the committee. This is on record that Justice Mansoor Ali Shah did not attend the meeting.In the absence of Justice Mansoor Ali Shah, Chief Justice of Pakistan (CJP) and nominated judge fixed the petition. The decision of two judges can not be declared decision of 3-member committee. 2-member committee cannot constitute the bench for hearing cases.Earlier CJP Qazi Faez Isa while giving important remarks said during hearing OF review petition against decision of interpretation of article 63-A, the cases of all applicants cannot be left at the discretion of one person.Barrister Zafar Ali told the court practice and procedure committee can constitute committee only when all the three members are present. If one member is not present then two members cannot make decision.CJP Qazi Faez Isa remarked Barrister Ali Zafar I am not agreed with you. If it happens so then this court will become dysfunctional. The cases of all applicants cannot be left at the discretion of one person.The petition said bench hearing review case of article 63-A has not been constituted under section 2 of practice and procedure law.As per practice and procedure amendment ordinance the presence of 3 judges was must in the meeting held under CJP. The committee was not complete due to non presence of justice Mansoor Ali Shah. Therefore, the constitution of benches is illegal.
