Petition against issuance of disqualification notification after conviction: LHS summons EC

Lahore: Lahore High Court (LHC) has summoned Election Commission on petition filed against notification issued in connection with disqualification after conviction.

As per media report, the petitions came up for hearing before justice Khalid Ishaq Wednesday.

Shahdzad Shaukat advocate gave arguments on behalf of Muhammad Ahmad Chatha and Muhammad Ahmad Khan Bhachar.

During the hearing of the case advocate Arshid Nazir Mirza appeared on behalf of Afzal Sahi memebr of provincial assembly in the court.

Shahzad Shaukat advocate took the plea in the court EC issued disqualification notice without hearing. Under 63-A the decision for disqualification be given after hearing the candidate. Court has given them sentence after hearing them.

Speaker assembly has to send the reference to EC. Neither the reference came to speaker nor he sent it to EC.

According to counsel decision came on July 13 and petitioner was declared disqualified on August 5. Will the ATC decision be considered like Supreme Court (SC) decision now.

The court inquired will you remain member of provincial assembly if your sentence is suspended.

The counsel said yes he will remain member.

Advocate Arshid Nazir Mirza said Wait was not made for 30 days in connection with appeal. Court should nullify the notification regarding disqualification.
