Petition on implementation of reserved seats decision: LHC seeks reply from federal govt, election commission on Sep 27

Lahore: Lahore High Court (LHC) has sought reply on September 27 from federation and Election Commission (EC) on the petition in connection with implementation of reserved seats decision.The petition filed by citizen Munir Ahmad regarding implementation of decision related to reserved seats came up for hearing before Justice Raheel Kamran Sheikh of LHC Friday.Advocate Azhar Siddique appeared in the court on behalf of petitioner.The state counsel told the court during the hearing of the case that meeting of Supreme Judicial Council (SJC) is underway. Attorney General (AG) is busy there. Petition has already been filed by barrister Gohar Ali Khan in Supreme Court (SC). The question is this PTI which is real respondent in this case has filed petition in SC. It has filed petition in SC.Justice Raheel Kamran Sheikh inquired from the counsel of the petitioner how this case is maintainable.Advocate Azhar Siddique said Additional Attorney General (AAG) had said on previous hearing such petitio n is pending hearing in SC. If any petition has been filed then it will have some number and some notice will have been issued.The counsel for the petitioner said the court had ordered on previous hearing that Attorney General should himself appear.Advocate Azhar Siddique said SC has repeatedly said the petition cannot be filed directly under article 184(3) of the constitution.Justice Raheel Kamran said clauses of NAB Act have been challenged in SC. Then how can it be challenged.Advocate Azhar Siddique said such petitions have not been filed after practice and procedure act. The petition against NAB act was filed before practice and procedure act. The election was not going to be held within 90 days then we filed petition in LHC.Advocate Azhar Siddique said when such petition was filed in SC then SC said high court should see this case first.The court inquired from state counsel this case can be filed any where as per law.Justice Raheel Kamran remarked the second part of the plea relates to giving seats to PTI. PTI will be given priority therein. If amendment act becomes unconstitutional even then SC decision will be implemented. If federal government and election commission don't file reply within 15 days the I will abolish your right to defence.The court sought reply from federal government and election commission on September 27.
