Islamabad: Supreme Court (SC) constitutional bench has issued notice to Advocate General (AG) in phone tapping case and adjourned the hearing of the case .Justice Muhammad Ali Mazhar remarked law does not allow every one to tap every phone. As per law only judge can allow to tap phone .Justice Jamal Mandohail remarked this case will have effect on several pending cases. This matter started from chamber of Chief Justice (CJ) and CJ will go where.A 7-member SC constitutional bench presided over by Justice Amin ud Din Khan took up the case for hearing Wednesday.Justice Muhammad Ali Mazhar remarked was any legislation made about phone tapping.Additional Attorney General (AAG) replied law is in place since 2013. According to it ISI and IB are notified. There is procedure laid down in the law and court's surveillance too is in law.Justice Muhammad Ali Mazhar remarked as per law only judge can allow for phone tapping. Has any judge been notified for this purpose.Justice Jamal Mandokhail remarked phone tapping law is ambiguous.Head of constitutional bench Justice Amin ud Din Khan remarked we are not interested in reports or law but we want result.AAG said he does not know about nomination of judge.Advocate on record said contact is not being made with the petitioner Mjor Shabbar in this case.The court while issuing notice to advocate generals adjourned the hearing of the case.
