Karachi: Sindh High Court (SHC) constitutional bench has remarked proceedings cannot be initiated on the basis of only misuse of powers without proving irregularity.The court ordered to finish ongoing NAB inquiry against officers of Sindh Public Service Commission (SPSC). NAB is not entitled to hold inquiry regarding examination.The court remarked on Thursday if NAB starts inquiry on every complaint then cases will open against entire country.The court remarked NAB is not authorized to scrutinize the matters related to examination. Mark sheets are protected under law.The court remarked if it is asked to conduct investigations against Prime Minister on the application from some citizen then can NAB do so.NAB investigation officer told the court Prime Minister and President enjoy legal protection and NAB cannot hold investigation against them.The court further inquired NAB gathered what material in this inquiry in six years.The investigation officer replied this inquiry was shifted to them in Jan uary 2025. Investigation into white collar crimes takes time.The officer said when notices were sent to the accused they resorted to court.The court directed NAB to initiate proceedings within their prescribed limits making it clear proceedings cannot be launched on the basis of merely misuse of powers without proving irregularity. For the time being decision has been announced verbally. Detailed written decision will be issued later.
