SC acquits father jailed for 12 years under allegation of committing rape with daughter


Islamabad: Supreme Court (SC) has acquitted a person who was imprisoned in jail since 12 years on the charges of raping his daughter.



The plaintiff mother and maternal uncle of the girl are not eye witnesses but they are rumors witnesses.



The property feud and domestic disputes also came on record.



The court declared the evidence of prosecution incredible .



A 10-page decision authored by Justice Ali Baqar Najafi was issued.



It has been said in the written decision the rationality test of victim girl was not taken while recording her statement. As per law a child is a competent witness if he/she passes a standard of sufficient maturity of understanding about the facts which were to be narrated by her



Contradictions were found in the statement while date and time was not clear.



The written decision said the doctor’s opinion too was contradictory. First it was said rape and then refusal was made in cross questioning.



A 6 or 7 years old daughter alleged her father of raping her in 2010. Trial court had awarded life imprisonment and Rs 35000 fine to the accused.



Lahore High Court (LHC) had upheld trial court decision in 2013.



The accused had resorted to SC against LHC decision.



A 3-member bench presided over by Justice Hashim Kakar had heard the case.
