SC allows military courts to conduct trial of civilians

Islamabad: Supreme Court (SC) constitutional bench has accepted appeals against the decision related to trial of civilians in military courts besides allowing the military courts to conduct trial of civilians.

A 7-member SC constitutional bench has announced the decision.

Intra court appeals have been accepted with 2-5 majority.

The judges who approved the appeals include Justice Amin-ud-Din Khan, Justice Muhammad Ali Mazhar, Justice Shahid Bilal, Justice Musarrat Hilali, and Justice Hasan Rizvi.

Justice Naeem-ud-Din Afghan and Justice Jamal Mandokhail dissented from the decision.

The bench had reserved judgment on May 5.

The court nullified 5-member bench decision and declared trial of civilians in military courts correct.

The court restored the clauses of army act which were nullified.

The court restored army act in its original form.

The three clauses of army act including 2-1-D, 2-D-2 and 59-4 were restored.

It has been said in the decision government should legislate with reference to give right to appeal within 45 days Amendments be made in army act for giving right to file appeal in high court.
