SC constitutional bench rejects plea for stopping hearing of intra appeal against decision of special courts, imposes fine Rs 20000 on former CJP Jawad S Khawaja

Islamabad: Supreme Court (SC) constitutional bench while rejecting the plea for stopping hearing of intra appeal against decision of special courts has imposed fine of Rs 20000 on former Chief Justice of Pakistan (CJP) Jawad S Khawaja.Justice Jamal Mandokhail remarked SC is working under constitutional amendment. What benches are being constituted they are being constituted under new amendment. The bench constituted under amendment will too hear the case of constitutional amendment.He gave these remarks on Monday.SC constitutional bench presided over by Justice Amin ud Din Khan heard the case Monday.The court inquired from counsel for Jawad S Khawaja " do you accept constitutional bench.The counsel said he does not accept power of jurisdiction of constitutional bench.Justice Jamal Mandokhail said to counsel for Jawad S Khawaja" then you should leave the room.The counsel said Judicial Commission (JC) has designated the present constitutional bench.The counsel for the petitioner said if co nstitutional amendment is nullified then the decisions given under this amendment will stand abolished.Justice Muhammad Ali Mazhar remarked decisions enjoy protection always. Such petitions are filed on every hearing.The court while dismissing the petition seeking adjournment of hearing of military courts case till the decision of 26th constitutional amendment case wrapped up the case.SC imposed fine of Rs 20000 on former CJP Jawad S Khawaja.
