Islamabad: Supreme Court (SC) has commuted life imprisonment of murder convict Arshid alias Billo to 15 years.
The SC has expressed annoyance over mentioning the word ” Neo Muslim in FIR and Police record and stopped IGs of all the provinces, and Islamabad Police from making mention of caste and community in FIR.
Justice Muhammad Hashim Khan authored the decision.
Bench comprised Justice Muhammad Hashim Khan Kakar, Justice Salah ud Din Panhwar and Justice Ishtiaq Ibrahim.
The court while issuing written decision said no difference occurs in the status or dignity of any one on the basis of embracing Islam in Islam . Showing some one new or separate on the basis of change of religion is illegal. Human dignity is basic right of every one.
The decision said the words “Musalli, Choohra, Bhangi are not identification of caste but they are used for degradation.
It pains that the society determines the respect of man with reference to his profession and not his dignity. Mentioning prefix or suffix of caste in police record runs contrary to basic principles of the constitution.
Justice Hashim Kakar wrote in the decision article 25 guarantees protection and equality to all citizens.
Article 26 prevents discrimination of any kind on the basis of religion , race, caste and gender. In the eyes of law every one is entitled to dignity, respect and equality no matter his profession is what.
It was said in the written decision that SC while stopping IGs of all provinces . and Islamabad police from making mention of caste or community said identification of any one with reference to caste or tribal identification will not be mentioned in recovery report or challan.
justice Hashim Kakar wrote the status of change of religion of any one or using degrading words will be prohibited.
Such mention will be made only when the investigation officer will have written and solid reasons in this regard.
Police had used the word Neo Muslim Sheikh with the name of plaintiff of the case Jahangir
