SC orders IHC to decide Emman Mazari, Hadi Chatha petitions regarding suspension of sentence


Islamabad: Supreme Court (SC) has ordered Islamabad High Court (IHC) to decide the petitions of Emman Mazari and Hadi Chatha regarding suspension of their sentence.



The court has remarked IHC should decide petitions filed by Emman Mazair and Haid Chatha seeking suspension of their sentence. The matter will remain pending with SC till the decision of IHC.



A 3-member bench of SC presided over by Justice Shahid Wahid issued the court’s order after hearing the case.



During it the counsel for Emman Mazari said IHC has taken only notice on appeal pleas against the sentence. Hearing of appeal pleas has not taken place again since more than two months. There is no relief for us in IHC.



Justice Naeem Akhtar Afghan said there is no order against you from high court.



Justice Shahid Wahid said high court has not dismissed the plea regarding suspension of sentence. We giver observation. it should decide the appeal within 2 weeks.



Counsel Faisal Siddiqui said court should order for decision on the petition related to suspension of sentence.



Justice Afghan remarked what are the parameters for suspending sentence. When the sentence is suspended. Had high court rejected the plea on suspension of sentence then we can go on merit.



Defence Counsel Faisal Siddiqui said no relief has been given by IHC. We should go where.



Upon it the SC while issuing the aforesaid order adjourned the hearing of the case for indefinite period.
