SC rejects different appeals regarding payment of alimony

Karachi: Supreme Court (SC) has rejected different appeals of the citizens regarding payment of Nan-Nafqa (alimony). The Chief Justice of Pakistan (CJP) Yahya Afridi remarked matters regarding scrutiny of facts should not come in SC. Examining facts is not job of SC. We will see here only violation of law matters. Family courts have to do the job of examining facts related to nan-nafqa. SC will not interfere in the matters of scrutinizing the facts.

The CJP gave these remarks while presiding over 3 members bench of SC Karachi registry during the hearing of appeal pleas filed by citizens related to payment of Nan Nafqa here Monday.

The counsel for the petitioner took the plea family court has ordered to pay alimony from the date of marriage and date of birth of children. The petitioner is ready to pay nan nafqa after the date of separation.

The CJP while moving to the counsel of the petitioner remarked you have not paid nan nafqa since 2022. You have not given a single pie to your children since three years.

Justice Muhammad Shafi Siddiqui remarked what you are saying , record will have to reviewed in this regard. The subordinate court is forum for scrutinizing the facts.
