Islamabad: Supreme Court (SC) has rejected election petition against JUI-F successful candidate from Mastung Nawab Aslam Raisani on technical basis.

SC declared non maintainable the election petition pertaining to Balochistan provincial constituency 37 Mastung.

A 3-member bench of SC presided over by Justice Shahid Wahid took up for hearing appeal plea against Election Commission (EC) decision Friday.

PPP candidate Sardar Noor Ahmad Bangalzai while challenging election tribunal decision in SC had requested for re-counting making alleged rigging basis of petition.

Wasim Sajjad counsel for the petitioner said the number of rejected votes in this constituency is very high.

Rejected votes in large number are affecting victory and defeat directly. EC rejected re-counting of votes.

Justice Amir Farooq remarked matter with us is entirely different. Your petition was declared non maintainable. The petition was rejected as the affidavit attached was not found authentic.

The counsel said we had attached affidavit duly attested by oath commissioner.

Justice Shahid Wahid said oath commissioner did not attest the affidavit as per rules. The statements of the witnesses have not been attached correctly.

Justice Shahid Wahid remarked it has been said in several decisions of SC if affidavit is not attested then such petition is not acceptable in election tribunal.

Justice Shahid Wahid said you had not given correct affidavit. As per settled principles it is imperative to file affidavit. SC has maintained non attested affidavit is not acceptable in election commission.

The counsel said why are you going to technical basis. My case is very simple. I have asked only for re-counting. What is wrong in re-counting.

Justice Shahid Wahid said your petition is dismissed.
