SC restrains CB Peshawar from issuing property tax notice on Evacuee Trust Property

Islamabad: Supreme Court (SC) has restrained Cantonment Board (CB) Peshawar from issuing property tax notices on Evacuee Trust Property.

A five members constitutional bench of SC presided over by justice Amin Ud Din Khan took up the case for hearing Friday.

The court while suspending Peshawar High Court (PHC) decision issued notice to CB Peshawar as well.

Counsel for Evacuee Trust Property Hafiz Ahsan argued the evacuee trust properties are owned by federal government. Cantonment Board cannot impose tax on properties of federal government. It is very clear in the constitution no other department can slap tax on the property of federal government.

After hearing the arguments of the counsel , the court suspended high court decision and restrained CB from issuing property tax notices on Evacuee Trust Property.

The court ordered CB to refrain from collecting tax till the next hearing of the case.
