Islamabad: Supreme Court (SC) Registrar office has returned the second petition against 27th constitutional amendment asking the petitioner he can resort to the Federal Constitutional Court (FCC) in this regard. Attempt was made by Justice (Retd) Shabbar Raza Rizvi to file the petition to challenge 27th constitutional amendment.
SC registrar office did not receive the petition. The petitioner took the plea legislative assembly had made constitution of Pakistan. The legislative assembly had declared Supreme Court (SC) the highest court in 1973 constitution. The present assembly is not constitution making assembly in any way.
It was said in the petition the basic features of the constitution cannot be changed. In Islamic state no one can be given immunity for life. The independence of judiciary is directly linked to appointment of judges. The constitution has been trampled in 27th constitutional amendment.
It has been requested in the petition SC should declare 27th constitutional amendment null and void and the life time immunity given under article 248 be also declared null and void. SC has earlier refused to receive petition against 27th constitutional amendment.
