SC seeks evidence about giving additional allowances on judges transfer

Islamabad: During the hearing of Islamabad High Court (IHC) judges transfer case Justice Muhammad Ali Mazhar of Supreme Court (SC) constitutional bench has sought evidence about giving additional allowances to the judges who have come due to transfer.

Justice Muhammad Ali Mazhar remarked additional allowances are given to judges who come due to their transfer. In my opinion additional allowances are not given to the judges who come due to transfer. If additional allowance is given then show us. There was a term fixed for transfer in the past. The time frame has been removed from 18th amendment. Can we force the constitutional makers to include the time frame again. If the posts of judges don't fall vacant then how the judge will be transferred. Now the powers for appointment of judge lie with judicial commission.

During the hearing PTI counsel raised the point of pressure on judges and affecting of seniority.

Upon it justice Shahid Bilal raised objection on the language of petition of Imran Khan saying high court judges may have felt ashamed over such language. It is my desire to dismiss this petition with fine.

A five members constitutional bench of Supreme court (SC) heard IHC judges transfer case Wednesday.

Giving arguments Faisal Siddiqui counsel for Karachi Bar said transferred judges are kept below every one in seniority list. The entire matter was created due to executive. The entire process was kept secret.

The hearing of the case was adjourned till Friday.
