SC upholds ST decision on payment of headquarters allowance to over 40 employees of FBR

Islamabad: Supreme Court (SC) while upholding Service Tribunal (ST) decision in connection with payment of headquarters allowance to more than 40 employees has rejected FBR appeals.

During the course of hearing of the case, the counsel for FBR took the plea executive allowance is given to government employees. But headquarter allowance was given to FBR employees instead of it.

He said the time scale employees are not entitled to this allowance. This is meant for only officers of grade-17 while the incumbent petitioners are not grade-17 employees.

The counsel requested that court should issue notice to finance division

The Chief Justice of Pakistan (CJP) inquired was the approval of the allowance given by prime minister remarking nothing like this is mentioned in the summary.

Justice Miangul Hassan Aurangzeb sought summary of headquarters allowance during the hearing and said the fact will become clear due to it.

The CJP remarked if FBR wants to separate Time scale employees then new summary be sent.

The court maintained this case falls in the jurisdiction powers of Service Tribunal and the decision given by Service tribunal in favor of employees will stay.
