Karachi: Sindh High Court (SHC) constitutional bench has ordered to appoint blind lawyer as judicial magistrate under Sindh Judicial Services Rules.

The court announced decision on petition filed by Syed Sadiq Hussain seeking relaxation in the rules related to appointment of blind lawyer as judicial magistrate.

SHC constitutional bench said court's decision be implemented within four weeks. If no seat is vacant then appointment be made on the post which will be advertised in future. The petitioner is a practicing lawyer and he can earn his livelihood through his practice as lawyer. We leave the matter of seniority of the petitioner on administrative committee.

The court ordered to send copies of decision to law secretary and registrar SHC.

The petitioner took the plea in the case that advertisement was published in news papers on December 1, 2014 in connection with appointment of judicial magistrate. The petitioner appeared before medical board after recommendation by selection committee. Medical certificate was withheld due to weak eye sight . I was asked to resort to SHC for concession in medical fitness.

According to petitioner he gave application to SHC registrar but no action was taken upon it. It is requested to court to relax rule regarding medical fitness.
