Karachi: Sindh High Court (SHC) has rejected the petition against the proposed constitutional amendment.The petition filed by the lawyers came up for hearing in SHC Monday.The Chief Justice (CJ) SHC remarked how can court interfere when amendment has not been made. How can we determine before amendment that amendment is being made as per law or otherwise.The petitioner said the draft of constitutional amendment has been brought in assembly.The court remarked then you came here with application. Those sitting in assembly are elected representatives of 240 million people.CJ SHC Muhammad Shafi Siddiqui inquired from the petitioner " have you read Supreme Court (SC) judgment on practice and procedure act.The lawyer said he had read judgment.The court remarked even then you dared to file such petition. How this petition is maintainable.The petitioner said Constitutional amendment is against the rights of the people and is an assault on the judiciary. The draft should be brought before bar co uncils and lawyers organizations before making constitutional amendment. There should be debate over it.The court remarked under what law we should order to present draft before bar councils and lawyers organizations. Application is filed by writing 3 or 4 lines. Then news is published in the news papers. How can we go against decision of 15-member bench of SC. Elected representatives of 240 million people are there in the assemblies.It is pertinent to mention here the petition has been filed by Ghulam Rehman Korai and others .The petition says federal cabinet had approved draft regarding amendment in the constitution on September 14. Draft of the constitutional amendment could not be presented in the parliament on September 15 for want of two thirds majority.
