Shifting Imran Khan to hospital case: SC seeks assistance from AG

Islamabad: Supreme Court (SC) has sought assistance from Attorney General in the case of shifting Imran Khan to Al-Shifa hospital in connection with Federal Constitutional Court (FCC) order.

A 3-member bench of SC presided over by Justice Shahid Wahid heard the case related to shifting Imran Khan to Alshifa hospital.

Justice Shahid Wahid inquired no one from among the respondents is in court room.

The court staff told that the attendance of Additional Attorney General (AAG) Rana Asad is marked. He is not in court room now.

Justice Shahid Wahid said let AG come then we will hear all.

Additional Attorney General (AAG) Rana Asad told the court FCC has issued an order yesterday. FCC has summoned record of this case.

AAG read out order of FCC.

Justice Shahid Wahid questioned from AAG Is AG present in the office.

AAG said yes AG is present in the office.

AG Mansoor Awan came in the court and read out FCC order saying FCC can not only summon record of the cases but also cases as per constitution.

Justice Shahid Wahid said court in its August 18 order had summoned government officers but no one has appeared. Is non appearance of the officers not non compliance. Some misperception lies some where. Keep this point at the side that the treatment will be carried out in private hospital or government hospital, Is the remaining part of our order being complied with. Were the meetings and talks with children arranged.

The learned judge said FCC cannot interfere in the matters related to Quran and Sunnah. FCC can only interpret the constitution. All the matters are held by SC except interpretation of constitution.

AG said FCC can interpret Quran and Sunnah.

Justice Shahid Wahid remarked should the court dismiss petitions today or should not hear them. Are we bound to the order of FCC.

AG said this matter has to be determined FCC can summon record from where and where.

Justice Shahid Wahid said it is written in the order of FCC that record be summoned and cases be fixed. AG should assist us how can FCC hear the cases.

Justice Shahid Wahid said Adiala jail administration was directed to appear in person today but no one appeared among government officers. SC decision has been violated.

Justice Shahid Wahid questioned from AG should we issue warrants of jail superintendent.

AG said it will be appropriate one chance be given more.

Justice Shahid Wahid said it is mentioned in FCC order it will determine who can hear the cases related to basic rights. The matter of basic rights is there in every case. The basic right of transparent trial comes to fore in every case.

Counsel Suleman Akram Raja said no constitutional interpretation was required in PTI founder appeal plea.

SC said the FCC ordered to call the record of cases and fix them for hearing. What will be the results of the order of fixing the cases for hearing. AG should assist us on this point.

AG Mansoor Awan said it will be appropriate that the court should adjourn the hearing of the case for three weeks.

The court adjourned the hearing of the case related to shifting Imran Khan to hospital for 3 weeks.
