Islamabad: Islamabad High Court (IHC) has issued notice to CDA on intra court appeal of the owners of apartments of one constitution Avenue besides seeking reply.
Adivision bench of IHD comprising justice Muhammad Azam Khan and justice Inam Amin Minhas of IHC took up the case for hearing.
Taimore Aslam counsel for the appellant took the plea there is no objection on the decision to the extent of declaring lease cancellation correct. Intra court appeal has been filed on observation of the court regarding third party rights.
The counsel said court has shown expectation that CDA and third party will reach acceptable solution. CDA wants that it should not go to acceptable solution.
The counsel said CDA entered into building and broke the locks before the copy of court decision was received.

According to the counsel CDA had asked for formation of committee comprising the residents to run daily affairs. The committee is running the matter along with CDA since 2023.
The counsel told the court there are two towers of one building wherein 240 apartments are located.
According to Taimore Aslam advocate CDA had no objection when building was being constructed. Overseas Pakistanis made investment in this project through their hard earned money.
He said apartments owners have nothing to do with BNP. Diplomats and families are residing in the building.
Justice Inam Amin Minhas remarked clear violation of supreme court 2019 order was committed. What will be its consequences.
The counsel said CDA was asked to give plan of action besides protecting rights of third party. CDA will not touch this plan because this is case of NAB and FIA.
He told Prime Minister has constituted a committee and approval from cabinet will be obtained after its recommendations.
The court while adjourning the hearing on intra court appeal gave indication to give decision on petition related to stay order later.
