Islamabad: Written order regarding rejection of five judges representation against changing seniority of Islamabad High Court (IHC) judges has been issued.

Justice Aamir Farooq had rejected the representation besides directing registrar to send copy of decision to respective judges.

The representation of justice Mohsin Akhtar Kiyani, justice Tariq Jahangiri. justice Babar Sattar, Justice Sardar Ejaz and Justice Saman Rafat was rejected.

Justice Sarfraz Dogar who has been transferred from Lahore High Court to IHC will remain puisne judge.

According to written decision there is no need of taking new oath by the judges who have been transferred from other high courts. There is difference between transfer and appointment of judges. The two are different things.

The decision said the transfer of judges in India is routine matter. There is no transfer policy in Pakistan like India but president can transfer as per law. The text of oath of judges of Indian high courts was also included in the text.

It has been mentioned further in the decision there is no need of taking oath again by the judges as per law. The text of judges oath is too part of the decision.

As per written order of high court, when a judge transfers then his status as judge of high court remains maintained and it is not changed. Article 200 of constitution relates to transfer of judge from one high court to other high court.
