IHC reserves judgment on petitions regarding Naval farm, Navy sailing club

ISLAMABAD: Islamabad High Court (IHC) has reserved judgment on the petitions pertaining to Naval Farms and Navy Sailing club after hearing the arguments from the counsels of the respondents.

Chief Justice (CJ) IHC Athar Minallah remarked two explanations are necessary before announcing the decision. He inquired from member if the law does not allow then you issue NOC to any one. For example high court can not do business and if we apply then will you issue NOC. Are you not subordinate to law and constitution. When such application comes then your first objection should be this that the application cannot be entertained. Could construction be made in zone 4 in 1993.

The member planning CDA told the court at that time constructing farm houses therein was allowed. Navy sailing club is sealed so far. Under building by laws the illegal building is razed.

The court inquired you do what when NOC of any housing society is cancelled.

CDA personal replied we take over it when NOC is cancelled. We seal the management offices of the illegal housing societies functioning without NOC.

The court inquired who is director housing Naval farms. Will you go to seal his office too. Why the action was not taken against the constructions erected along the small dams bank on Rawal lake.

The court reserved the judgment.
