Islamabad: During the hearing of the case seeking abolition of terrorism clauses against senior journalist Mati Ullah Jan, Supreme Court (SC) has rejected Mati Ullah Jan plea for issuance of stay order on trial court proceedings.

The court issued notice to prosecution.

The court sought report regarding new challan against Mati Ullah Jan.

The hearing will continue today.

Justice Naeem Akhtar Afghan remarked indictment can be withdrawn even if it is made.

He gave these remarks during the hearing of the case on Wednesday.

A 3-member bench of SC presided over by Justice Muhammad Ali Mazhar took up the case for hearing.

The counsel for the petitioner said challan has been filed in Anti Terrorism Court (ATC) .This case was framed to stop reporting on political party protest. Indictment has to be made on Thursday. The court should issue order to stay the proceedings of trial court.

Justice Musarrat Hilali said there is no bail in narcotics case.

The counsel for the petitioner said narcotics has not been recovered from Mati Ullah Jan as per forensic report.

Justice Naeem inquired why this case was not fixed in high court again.

The counsel told high court did not fix the case again after February 23.

Justice Naeem Akhtar said such cases are decided in a week.

Justice Musarrat Hilali said has the petitioner objection over the bench.

The petitioner Mati Ullah Jan expressed full confidence on the bench.

The court while issuing notice to prosecution for Thursday (today) has sought report from them about new challan.

The hearing of the case has been adjourned till today (Thursday).
