Islamabad: Justice Mansoor Ali Shah has remarked that the case related to the bench's jurisdiction has nothing to do with 26th constitutional amendment.

"If some one starts scaring on their own then it is a separate matter, he gave these remarks while presiding over two members bench during a contempt of court hearing on Wednesday regarding the non-scheduling of a case on the powers of benches

SC appointed Khawaja Haris, Ahsan Bhoon new amicus curiae.

Amicus curiae proposed to constitute full court.

Justice Mansoor Ali Shah inquired can we issue order for full court while hearing contempt of court case.

Munir A Malik said committee decision has been presented as defence. The court can order for full court on committee powers. First case was fixed in this bench erroneously If it was mistake even then judicial order has been issued on this. Now judicial order can be changed by second judicial order.

The matter is now linked to independence of judiciary. The matter can be resolved once for all through full court.

Attorney General (AG) said court has very limited jurisdiction powers in contempt of court case. Written reply should be filed first by the one to whom show cause notice has been issued. There is objection over appointment of amicus curiae. The two lawyers who have been appointed amicus curiae are counsels of the petitioners in petition against 26th constitutional amendment.
