Islamabad: Justice Mohsin Akhtar Kayani of Islamabad High Court (IHC) has remarked the children cannot be divided as the conflicts take place between wife and husband but these should not be changed into conflicts between father and mother.
He gave these remarks during hearing of a case pertaining to quarrel between husband and wife and handing over custody of children here Friday.
The petition filed by woman citizen in connection with custody of children came up for hearing before Justice Mohsin Akhtar Kayani.
Husband and wife appeared in the court along with their counsels.
During the hearing of the case the court directed that all the children be presented in the court on next hearing.
Justice Mohsin Akhtar Kayani remarked the children cannot be divided. Quarrels take place between husband and wife but these should not be converted into quarrels between father and mother.
During the hearing of the case Justice Mohsin Akhtar Kayani remarked transferring the home in the name of wife is not a big matter. His own property is in the name of his wife.
He further remarked judge and lawyer are enemies of wife, husband and children.
The judge and the lawyer cannot resolve the matter what husband and wife can resolve.
On being inquired from the court the counsel for the petitioner told there are four children with age ranging between 4 and half year and 12 years. They include two sons and two daughters. Minor son is with the woman and three children are with husband.
The court inquired has separation taken place between husband and wife.
Both of them stated neither separation has taken place nor they want separation.
To this question then what is problem that they are living in separation since 4 years, husband replied he neither wants separation nor has he contracted second marriage. Wife is demanding the home be transferred in her name.
Upon it Justice Mohsin Akhtar Kayani remarked it is not a big thing.
Justice Mohsin Akhtar Kayani asked both husband and wife that they are making rounds of the courts since long , therefore, they should sit together and resolve the problem.
You should learn pardoning and apologizing to each other. If one gets angry then the other should stay silent.
It is patience of the woman that she leaves parents and lives with the husband.
The court remarked it is time of upbringing the children. The children will grow young within a few years and they will hate both of you. At that time if you go for reconciliation then it will be of no avail.
On being inquired from the court both husband and wife got ready to apologize to each other.
The court directed both of them to sit together in the court room.
The court remarked all the four children be presented in the court on next hearing.
The hearing of the case was adjourned till next Friday.
