Constitutional Court upholds MA graduate sweeper’s job, orders suitable alternative posting

Islamabad: The Federal Constitutional Court has dismissed an appeal challenging the appointment of a Master of Arts (MA) graduate as a sweeper in Khyber Pakhtunkhwa, while directing the provincial government to provide him with a more suitable position in accordance with his qualifications.

A three-member bench headed by Justice Hassan Azhar Rizvi observed that assigning sweeping duties to an MA graduate reflected a failure of the system and ruled that it would be inappropriate to terminate his employment after ten years of service.

During the hearing, Justice Rizvi remarked that it was alarming for a highly educated individual to be working as a sweeper, describing the situation as a tragedy and a matter of serious concern for the system.

The Additional Advocate General of Khyber Pakhtunkhwa informed the court that there were currently no vacant sweeper posts in the province. In response, Justice Rizvi questioned whether the province had become so clean that sweepers were no longer required.

The District Education Officer told the court that the employee's duties included sweeping and cleaning. Justice Rizvi questioned whether anyone felt embarrassed assigning such work to a person with a postgraduate qualification.

The court upheld the Peshawar High Court's earlier judgment, dismissed the appeal and directed the provincial government to appoint the employee to another suitable post commensurate with his educational qualifications.
