Lahore: Lahore High Court (LHC) has rejected petition for recovery of PTI social media activist Falak Javed declaring it unnecessary. The court has directed counsel for the petitioner to resort to ATC.
Petition for recovery of PTI social media activist Falak Javed came up for hearing in LHC. The petition has been filed by Javed Iqbal father of Falak Javed. Justice Shahbaz Rizvi took up the petition for hearing.
Home secretary, IG Punjab and others have been made respondents in the petition. The court directed counsel for the petitioner to resort to ATC. The counsel for the petitioner took the plea Falak Javed was released from Kot Lakhpat jail. However she was again arrested soon after her release. According to counsel stance was taken about registration of no case against Falak Javed in the report filed in LHC while arrest after release was declared illegal.
The counsel told the court during the hearing of the case bail of Falak Javed was approved in Fake video case. However Race Course police arrested her in May 9 case on the same day and obtained her physical remand.
According to counsel Falak Javed was arrested in supplementary statement and her remand was obtained without presenting her in ATC. Assistant Advocate General (AAG) Farrukh Khan Lodhi told the court ATC has handed over Falak Javed on physical remand.
The counsel informed the court Falak Javed has to be presented in the court again today.
The court inquired how the petition is maintainable. The court directed counsel for the petitioner to approach ATC. Justice Shahbaz Rizvi made it clear high court is not deciding remand case besides directing the counsel to challenge the remand given in respect of Falak Javed in respective court.
The court was requested through the petition to recover Falak Javed and issue order for her release.
The court however rejected this plea.
