Islamabad: Punjab government has raised objection over bench during the hearing of former federal minister Fawad Chaudhry petition for clubbing cases in Supreme Court (SC).
Petition filed by Fawad Chaudhry against several cases of May 9 incident registered against him came up for hearing in SC Tuesday.
A two members bench of SC presided over by Justice Hashim Kakar heard the case.
Fawad Chaudhry while giving arguments said 35 cases in connection with one incident have been registered in different police stations which run contrary to the norms of law and justice. Legal complications arise in such cases. This step can take shape of political revenge.
He took the plea several FIRs cannot be registered on one incident. All the cases be clubbed and one trial be conducted.
Justice Hashim Kakar head of the bench remarked prima facie proceedings can be conducted on the basis of first FIR.
During the hearing of the case Punjab government raised objection over the present bench of SC.
The prosecutor informed the court Fawad Chaudhry has filed appeal against decision of 2 members bench of Lahore High Court. Only 3-member bench can hear this appeal constitutionally.
The court while agreeing to this point sent the case to SC judges committee so that it could be fixed before 3-member bench.
SC directed registrar office the case be fixed for hearing before 3-member bench on next Monday.
