Islamabad: Federal Constitutional Court (FCC) while giving big relief to KP government has declared the appointments made during the care taker government against the law.
FCC issued important decision on the powers of care taker governments. The court declared the law made for dismissal of employees is according to constitution. A 3-member bench of FCC presided over by Justice Hassan Rizvi issued written decision.
The FCC has maintained in the decision job of care taker governments is dealing with daily routine matters. Care taker government cannot give such decision which is of permanent nature. Care taker government can never be at par with elected government in terms of powers. Every step of care taker government is conditional to advance approval of Election Commission (EC). The appointments of employees is job of permanent nature and not temporary. The appointments made by care taker government from January 2023 to February 2024 are against the rules. KP employees dismissal from service act -2025 is not against the basic rights. KP assembly came into being as a result of election. It wields powers for legislating. The FCC dismissed the appeal pleas filed by sacked employees.
