Islamabad: Federal Constitutional Court (FCC) has dismissed the appeal pleas against cancellation of allotment of 577 kanal land in Murree.
The court has ordered to hand over possession of land worth over Rs 40 billion to Punjab government.
A two members bench of FCC presided over by Justice Amir Farooq took up appeal pleas for hearing.
The counsel for petitioner raised the question how the allotment of land can be declared illegal after decades.
Under what law the allotment has been declared illegal was not enacted at that time.
Additional Advocate General (AAG) Punjab took the plea only agriculture land can be allotted under settlement scheme. While the land which has been allotted is urban. The allotment of the land was wrong. How can be the building valid when the foundation is illegal. Kohsar university is being built on some part of the land. Some part is under use of Girls Guide and Scouts. The land will be used for Murree beautification project.
If the petitioner has any claim in return for agriculture land then he should resort to proper forum.
The court dismissed the appeal after hearing the appeal pleas of respondents.
