Islamabad: Federal Constitutional Court (FCC) has declared Supreme Court (SC) decision regarding demolition of Pir Sohawa Monal restaurant null and void.

FCC approved appeal pleas from CDA and Metropolitan city besides vacating stay order. Trial courts were directed to decide the cases as soon as possible.

FCC maintained that the trail courts will decide about ownership without being influenced by previous judicial observations. Regulatory bodies determine administrative matters.

Justice Hassan Rizvi said several points were not kept into view in SC decision.

He said that the court had also expressed resentment over filing the case or review petition. What was written in the decision was not mentioned in the case's narrative. We have not to give emotional decision.

Counsel Ahsan Bhoon said court has read the case very well. Upon it Justice Hassan Rizvi said don't admire us in the court. We would give the order solely on the basis of proceedings.

He observed judgment would remain focused on the legal issues and 'would not read like a tale from Alif Laila.

Justice Hassan Rizvi maintained it appeared when we read the decision that a lot was written beyond the scope of the court's proceedings.
