Islamabad: Supreme Court (SC) has acquitted accused Muhammad Siddique in murder case.

The accused was nominated in murder case.

As per media report the court maintained giving benefit of doubt to the accused is not any leniency but it is his legal right.

The SC declared Lahore High Court Rawalpindi bench decision on award of sentence to the accused null and void.

The court remarked that merely a reasonable doubt is sufficient to give benefit to the accused. Giving the benefit of doubt is not concession but it is legal right.

The decision said the recovery and forensic evidence are not effective without direct reliable evidence.

The SC declared that decisions of trial court and high court are based on wrong reviews of evidence.

The court rejected the plea of prosecution to enhance the sentence.

The court identified suspicions, suspicious presence of alleged eye witnesses, contradictions in the statements of witnesses and unnatural aspects in prosecution case. The unexplained delay in FIR and postmortem further weakened the stance of prosecution. The motive behind the murder could not be proved.

It is pertinent to mention here trial court had awarded death sentence and fine Rs 5 lac to the accused Muhammad Siddique under section 302(b).

Lahore High Court Rawalpindi bench had commuted death sentence to life imprisonment.
