Islamabad: Hearing of intra court appeals against decision of trial of civilians in military courts will continue in Supreme Court (SC) constitutional bench in next week.
Justice Jamal Mandokhel inquired can the courts constituted for purpose of 8 (3) conduct trial of others. As per constitution armed forces are under executive. Can forces which are under executive exercise judicial powers or otherwise. Should court be free or otherwise.
A 7-member SC constitutional bench presided over by Justice Amin ud Din Khan heard the case Thursday.
Aziz Bhindari counsel for Imran Khan argued we have to see constitution allows what things.
He said army act relates to only discipline. Those related to clause C can never conduct court martial. Only officers conduct court martial.
He took the plea parliament does several things itself. But parliament does not do every thing. what is not done by parliament, judiciary can do it.
Justice Jamal Mandokhel questioned will military justice system continue to run after removing 21-D-1.
Hearing of case was adjourned till February 24.
