Islamabad: The miscellaneous petition seeking shifting Imran Khan to hospital came up for hearing in Islamabad High Court (IHC) in Toshakhana criminal case.
IHC bench comprising Justice Arbab Muhammad Tahir and justice Khadim Hussain Soomro took up the case for hearing Tuesday.
During the hearing of the case Advocate General (AG) Islamabad told the court jail superintendent report has been filed in court.
The court remarked this report should have been provided to respondents first .
As per AG Islamabad , press release of PIMS has also been attached with the report which has been reported in news papers.
The court inquired was the treatment carried out in hospital earlier and the session was held later in PIMS hospital.
The court was told upon it PIMS doctor conducted medical check up in Jail hospital. The doctor proposed injection can be administered in hospital. Under this requirement the PTI founder was shifted to PIMS twice.
During the course of hearing of the case Latif Khosa advocate said report of friend of court barrister Suleman Safdar has been attached with miscellaneous petition which he had filed in Supreme Court as friend of court.
Barrister Aitzaz Ahsan too appeared in the court and took the plea the authentication of the power of attorney is not being allowed .
Justice Arbab Muhammad Tahir inquired court should hear appeal or plea for medical ground.
The court directed AG to get sign power of attorney of Aitzaz Ahsan and file it in the court.
Sardar Latif Khosa argued that PTI founder was in Attock jail after conviction where he was kept in strange situation.
He said petition in supreme court was filed in 2023 with reference to plight of PTI founder in jail and court had called report. The case was fixed for hearing in 2026 after three years where he informed the court about eye problem of PTI founder. While government kept on denying for five days and later press release was issued.
The hearing of petition for shifting PTI founder to Shifa Hospital was adjourned till March 12.
The court directed Khosa Sahb should tell the relevant jail rules.
Latif Khosa said please fix it for tomorrow and I will assist the court.
Justice Khadim Hussain Soomro said he is not available for tomorrow. Being unwell I have come today.
Justice Arbab Muhammad Tahir remarked you both sides should come prepared and we will decide after hearing you on March 12.
The court adjourned the hearing of the case till March 12.
