Executing murder convict father is tantamount to render his daughter orphan under court patronage: SC

Islamabad: Justice Ishtiaq Ibrahim of Supreme Court (SC) has maintained in his decision that executing father , convicted in murder case is tantamount to render his daughter orphan under court patronage.

SC remarked keeping in view the best interest of children is responsibility of the state as per UN convention.

When heir is direct heir of the victim then Qisas cannot be applied under section 306. The accused is left the only supporter of his daughter Insa Amin-15 .

The SC announced the decision on appeal plea of culprit Muhammad Amin.

The court declared null and void the decision of awarding death sentence to the culprit. The court commuted the death sentence of culprit Muhammad Amin into life sentence.

Trial court and high court had announced death sentence to culprit twice.

The court remarked converting death sentence into life imprisonment is not forgiving the crime but it has to be ensured this thing that state does not become cause for complete helplessness of any children.

It is pertinent to mention here the convict Muhammad Amin had stabbed his wife and daughter stabbed to death in Vehari in April 2021. He entered into quarrel with his wife and children on the sale of agriculture land a day before the incident.
