Islamabad: Islamabad High Court (IHC) has directed to fix for hearing in the second week of November the petition filed against the appointment of district and sessions judge Nasir Javed Rana who has awarded sentence to PTI founder and Bushra Bibi in 190 million pounds NAB case.

The Chief Justice (CJ) IHC Sarfaraz Dogar remarked this case will be heard in the second week of November. Today I am unwell.

The miscellaneous petition filed by the petitioner Osama Riaz seeking early hearing of the case against the appointment of judge Nasir Javed Rana came up for hearing before CJ IHC Sarfraz Dogar Friday.

The CJ IHC inquired from Riaz Hanif Rahi , counsel for the petitioner what is this matter and is it order of 2004.

Hanif Rahi advocate took the plea Nasir Javed Rana was declared unfit for judicial service in Supreme Court (SC) October 19, 2004 decision. Therefore his appointment as judge is illegal.

The counsel said this matter relates to the case of late Wahab ul Khairi. Had he been alive he would have watched this decision. Therefore he filed petition.

The CJ IHC Sarfraz Dogar said he is unwell today therefore, he will hear this case in the second week of November.

The petition said Nasir Javed Rana be prevented from performing duty and notification regarding his appointment be declared null and void.

It was further said in the petition if the judge has been retired before the decision was made then all the perks and privileges availed by him after December 14, 2022 be withdrawn and he be declared not entitled for pension and other benefits.

The court while directing to fix the case in the second week of November adjourned the hearing of the case.
