Islamabad: Islamabad High Court (IHC) while removing registrar office objections over petitions filed by PTI founder and Bushra Bibi against alleged solitary confinement has directed to mark number on them.
The court has maintained the matter of maintainability of the petitions will be seen on judicial side. Justice Khadim Hussain Soomro took up petitions filed by Aleema Khanum and Mubashra Khawar Monika for hearing. During the hearing of the case Barrister Suleman Safdar, Suleman Akram Raja and other lawyers appeared in the court. Aleema Khanum, Shandana Gulzar and other leaders were also present in the court.
Barrister Suleman Safdar took the plea registrar officer has raised objection that petitioners are not aggrieved party while Aleema Khan is sister of PTI founder and Mubashra Khawar Monika is daughter of Bushra Bibi. Therefore, they are entitled to file petition.
Citing to previous decisions of Supreme Court (SC) and IHC he said the family members of the prisoners can file petitions of such nature. He told the court meeting with Bushra Bibi could not take place after December while meeting with PTI founder was arranged two time under the orders of Chief Justice of Pakistan and Chief Justice IHC. Neither TV nor news papers are being provided to Imran Khan while both Imran Khan and Bushra Bibi are in solitary confinement since the last seven months which is tantamount to inhuman treatment.
Justice Khadim Hussain Soomro called NAB Prosecutor Rafa Maqsood on rostrum during the hearing.
NAB prosecutor took the plea the miscellaneous petition related to solitary confinement has been already rejected during the hearing of appeals. Therefore, this matter cannot be raised through constitutional petition but SC can be approached in this regard.
Suleman Safdar said his petition regarding solitary confinement has not been rejected . If it may have happened so then he will present its authenticated copy in the court. Chief Justice bench has not issued any order on this matter.
On conclusion of arguments the court removed registrar office objections and directed to mark number on the petitions. The court maintained the matter of maintainability of the petitions will be seen on judicial side. The court adjourned hearing of the case till Tuesday on the request of Barrister Suleman Safdar.
