Islamabad: Islamabad High Court (IHC) judges have challenged hearing of intra court appeal in Federal Constitutional Court (FCC) in judges transfer case.

Through the petition by 5 judges . request has been made to return intra court appeal to Supreme Court (SC).

The petition said the appeal plea has been shifted to FCC due to 27th constitutional amendment while the 27th constitutional amendment runs contrary to the constitution.

The petition further said legislature executive and judiciary were established under 1973 constitution. These are three pillars under the constitution. Distribution of powers and limits are very clear in the constitution. Power for making amendment in the constitution cannot be used for eliminating judiciary. The decisions of SC on distribution of powers are very clear.
