Lahore: A division bench of Lahore High Court (LHC) has recused from hearing petition filed by Hassaan Niazi nephew of Imran Khan against his military custody, proceedings of military court and court martial.

The court while sending the case file to Chief Justice (CJ) LHC has recommended to fix it for hearing before some other bench.

A two members bench of LHC presided over by Justice Farooq Haider took up the case for hearing Thursday.

Faisal Siddiqui counsel for the petitioner appeared in the court.

The petitioner took the plea in the petition that he was not presented in any civilian court after his arrest in May 9 case.

Sarwar road police handed over his custody to military. He was handed over to military authorities illegally without any judicial oversight .

The petitioner requested that August 17. 2023 commanding officer notification on taking him into military custody be declared null and void.

Handing over him to military custody, all the proceedings of military court and proceedings of court martial be nullified.

The petitioner requested the court to issue order for releasing him or presenting him in Anti Terrorism Court (ATC).
