Lahore: Lahore High Court (LHC) while accepting the appeal of death convict has ordered to acquit him.
The LHC declared null and void the decision of trial court and ordered to acquit criminal who was awarded death sentence by trial court for killing his friend.
According to media reports LHC bench comprising Justice Farooq Haider and justice Ali Zia Bajwa announced this decision.
According to the court's decision the prosecution failed in proving its case against the accused who was arrested for murdering his friend after exchange of minor bitter remarks.
The court remarked a clear contradiction was found in the statements of star witness of the prosecution. The evidence were also not collected in correct way.
Justice Farooq Haider said in the decision the pistol recovered from the accused was empty. It was not even sent for forensic analysis which is gross flaw in the investigation.
According to judicial record murder case was registered in police station Sargodha in 2014 while trial court had awarded death sentence to the accused in 2022.
The LHC maintained prosecution failed to prove case, therefore the accused is acquitted by giving him benefit of doubt.
