Lahore: Lahore High Court (LHC) has rejected appeal plea of culprit Muhammad Ashraf against life imprisonment awarded to him for clubbing his wife to death and upheld the sentence.
Justice Asjid Javed Ghurral of LHC has issued 6-page decision.
It has been said in court's decision his son is eye witness against the criminal Muhammad Ashraf. Father holds an esteemed position in our society and no son can level such false allegation against his father. Either son leveled allegation of murder against his father himself and without any evidence this allegation cannot be refuted.
It has been said in the decision the counsel for the culprit had taken the plea there were other children of the victim too but no one among them charge sheeted their father. But the court sees the importance and not the number of witnesses. Every one can understand if there is allegation of murdering the mother against father then the children will be in what situation. Therefore, it cannot be expected from every child that he will record evidence against his father.
It has been further said in the court's decision that fear, scare and loyalty these all things can influence the child. Not recording the evidence by other children against their father does not weaken the prosecution case.
The decision said the accused cannot be acquitted merely on saying this there was no reason to murder the victim. Prosecution fully succeeded in proving its case.
The court upholds the conviction of the accused by rejecting his appeal against sentence.
It is pertinent to mention here that case was registered against the accused Muhammad Ashraf in police station Gujranwala in 2021.
In 2022 sessions court Gujranwala had awarded life imprisonment and fine to the accused.
