LHC rejects former registrar high court petition against recovery of Rs 4 lac monthly allowance

Lahore: Lahore High Court (LHC) while rejecting petition against recovery of Rs 4 lac monthly allowance from former registrar high court has maintained writ petition filed against the administrative decision is not maintainable.

Justice Raheel Kamran Sheikh of LHC issued 10-page detailed decision on the petition filed by former DG Punjab Judicial Academy Syed Khurshid Anwar.

The court maintained any administrative or consultative decision of high court cannot be challenged under constitutional jurisdiction of powers. Relying on Supreme Court precedents it was said writ petition against high court cannot be filed in the same high court.

The court further maintained post of registrar high court is part of judicial service and the matter of allowance comes under service matters. Therefore, the respective forum should be approached for redressal of disputes of such nature.

Justice Raheel Kamran Sheikh said in his decision judicial officers should approach Punjab subordinate Judiciary service tribunal for redressal of their grievances regarding service. The court made it clear the claim of former DG of Punjab Judicial Council regarding equal allowance cannot be maintained following the abolition of registrar high court allowance. Because the said allowance was given on the basis of equality. The court directed the petitioner that he can resort to some other proper legal forum or tribunal as per law.
