Lahore: Lahore High Court (LHC) has set guiding principles for summoning the witnesses. Justice Anwar Hussain of LHC while issuing an important decision with reference to summoning the witnesses to court has maintained it is not necessary to give new list of witnesses if new questions come to fore in the case. Justice Anwar Hussain of LHC has issued 7-page written decision on the petition of citizen Rizwan Rashid. The petitioner had challenged trial court decision in high court. The court wrote in the decision the basic objective of judicial laws is to make easy access to justice and not to entangle the citizens into technical complications.

The court while nullifying trial court decision on rejecting the petition on technical reasons remarked if the rival party did not present its own listed witness in the court then the other respondent can summon him.

The court allowed the petitioner to summon bank manager as witness.

It was said in the decision the petitioner had solid reason to summon bank manager as witness . Name of bank manager was already included in the list of witnesses. Therefore, petitioner had not included him in the list of witnesses.

The court also noted the petitioner had to file petition for summoning Bank manager under compulsion due to non presentation of the witness by rival party.

LHC maintained rejecting the petition by subordinate courts for making bank manager witness was wrong and against the norms of justice.
