Islamabad: Federal Constitutional Court (FCC) while rejecting appeal plea of private bank in Online bank fraud case has ordered the bank to return amount to affected citizen.
Justice Amir Farooq remarked hackers are within the system of the banks. It is duty of the banks to make their system secure.
A two members bench of FCC presided over by Justice Amir Farooq took up the case related to online fraud for hearing.
The court while rejecting the appeal plea of the bank directed the bank to return amount to the effected citizen.
A sum of Rs 1534000 were extracted from account of resident of Layyah in 2022.
During the hearing of the case Justice Amir Farooq remarked all hackers are within the system of banks. The data of account holder reaches the hackers before the bank account is opened.
Justice Amir Farooq disclosed he has too received call of fraudsters.
He said he was holding account in a private bank wherein it was said that " share on OT, otherwise account will be blocked.
According to Justice Amir Farooq as no transaction was made in the bank since several years therefore, he asked the bank to close the bank account.
Justice Amir Farooq remarked he himself does not use Online account. While it is duty of banks to strengthen their system.
Justice Amir Farooq raised question people should go where ultimately. How the amount is extracted from account.
The counsel for the private bank took the plea the citizen had transferred the amount through his own app.
The citizen said his mobile number was stolen.
The court remarked Banking mohtasib, President Pakistan and high court had already given decision against the bank.
FCC too dismissed the appeal .
