Islamabad: Islamabad High Court (IHC) has directed counsel for the petitioner to present court's precedents in the form of parawise comments in the petition from former air marshal Jawad Saeed for providing proceedings of court marshal and details of charge sheet.
The matter of court marshal sentence against former air marshal for leaking sensitive information came up for hearing Thursday.
Proceedings of court martial and record of charge sheet was not provided to former air marshal Jawad Saeed by Air Force authorities.
The court directed the counsel for the petitioner to present court's precedents regarding production of record on next hearing.
Abdul Wahid advocate counsel for the petitioner appeared in the court.
Additional Attorney General (AAG) and Air Force legal authorities appeared in the court.
Air Force authorities said as per PAF Act if you have to award death sentence then it is enough to write one sentence. Power of attorney is being sought. Verified copies are being demanded.
According to PAF law record of punishment and charge sheet cannot be provided.
Justice Khadim Hussain Soomro said We cannot say any thing about what is your law.
The counsel for petitioner said such thing has not ever happened here on their law.
Air Force authorities said Your appeal has been rejected.
Counsel for the petitioner said justice has not been provided to us. what is allegation was not told to the family. His own counsel was not provided to the accused.
The court remarked " present the court's precedents on next hearing in the court wherein record was provided in such case before.
The counsel for the petitioner said court should give time I will present supreme court precedents and decisions. Full bench judgments are available in such cases I will present them in the court.
Justice Khadim Hussain Soomro said " you should present court's precedents in the form of parawise comments.
The court adjourned the hearing of case till June 17.
