PHC moved against postponing the by election on Senate seat by EC

Peshawar: Petition has been filed in Peshawar High Court (PHC) against Election Commission (EC) for postponing by polls of Senate in Peshawar.

As per media report, the petition has been filed by Irfan Salim who is nominated candidate of PTI.

The petitioner has taken the plea that EC postponed the by polls on Senate seat without legal powers.

Secretary EC, Chief Election Commission, provincial election commissioner and other respective authorities have been made respondents in the petition.

It has been further said in the plea that Senate seat is vacant since March 25, 2026 after disqualification of Murad Saeed. Therefore, election should have been held timely as per constitutional requirements.

The petitioner told the court the by poll was postponed illegally by EC through its circular issued on April 21, 2026. Citing to article 224 (5), it has been said in the petition holding election within 30 days on vacant seat is constitutional requirement.

It has been requested in the petition court should declare EC decision illegal besides ordering the respective authorities to hold by polls on Senate seat forthwith.
