Peshawar: Peshawar High Court (PHC) has restrained Election Commission (EC) from taking any adverse action against KP Chief Minister (CM) Ali Amin Gandapur.
The petition from Ali Amin Gandapur against EC notice came up for hearing Tuesday.
Justice Syed Arshid Ali and Justice Muhammad Fahim Wali took up the petition for hearing.
Bashir Khan Wazir advocate counsel for the petitioner said EC issued this notice to Ali Amin Gandapur on September 2. EC has issued notice in regard to election expenses. But EC can give this notice within 90 days after election.
The counsel for the petitioner said EC cannot take action against the member of assembly after 90 days. However if election tribunal is established then they can go there. Earlier EC has issued notice too.
Justice Syed Arshid Ali inquired from counsel for EC how can EC hold inquiry against him after 90 days .
Deputy Director Law EC told the court a supreme court decision is there that action can be taken on corrupt practices. There is no binding of time in this regard.
The EC while issuing notice to EC sought reply within 14 days.
