Powers enhanced of CJP in practice, procedure amendment ordinance challenged

Islamabad: The powers enhanced in respect of Chief Justice of Pakistan (CJP) in practice and procedure amendment ordinance have been challenged in Supreme Court (SC).Chaudhry Ehtisham ul Haq advocate filed petition in SC making secretary for law ministry, secretary establishment and secretary cabinet respondents.The petitioner has taken plea in the petition promulgation of ordinance is against parliamentary democracy. SC has also maintained the ordinance can be promulgated in emergency only.It has been requested in the petition the amendment ordinance be declared in conflict with constitution. All the steps under ordinance be declared null and void.The petitioner said the people rights are being violated through the ordinance. In article 9, the people are at liberty to resort to independent judiciary. Under article 10 fair trial is part of constitutional rights of the people.It was further said in the petition additional powers are being given due to ordinance and its routine use is curtailing t he powers of the parliament. The powers of independent judiciary will be affected due to the ordinance. It will leave negative impact on decisions of SC.
