Lahore: Chief Justice (CJ) Lahore High Court (LHC) Aalia Neelum has maintained proceedings cannot take place on different forums for the same nature relief.
CJ LHC issued 4-page decision on the petition of citizen Munir Ahmad.
Azhar Siddique advocate gave arguments on behalf of the petitioner .
CJ LHC expressed annoyance over filing unnecessary petition maintaining this petition has already been filed and rejected in Islamabad High Court (IHC). Court's time is very precious which should be allocated for serious problems. Such petitions are filed without any responsibility, restraint and legal process. The courts are filled with cases of unnecessary nature due to habit of filing cases without reason.
CJ LHC wrote in her decision petition of public interest is filed on every thing. Such petitions are filed for earning fame Such process is tantamount to undermine the worth of public interest related petitions. Court time is wasted in hearing petitions of such petitions. Otherwise this court will become a glum spectator where time and money of people is wasted.
According to decision it was requested in this petition that SOPs of PNIL be declared null and void.
State counsel said the petitioner Munir Ahmad filed petition of such nature in IHC which was rejected therein.
According to counsel the petitioner has concealed this fact from LHC.
Advocate Azhar Siddique said the present petitioner had not filed petition in IHC.
It was said in the decision advocate Azhar Siddique accepted that he himself was lawyer in the petition filed in IHC. However he remained unable to tell he had made mention of petition filed in IHC where in this petition.
Azhar Siddique advocate concealed the information about the petition filed in IHC while filing petition in LHC.
Advocate Azhar Siddique said he is unaware of any court's order in respect of petition filed in IHC. Azhar Siddique advocate was informed about the order of IHC wherein his attendance was marked.
It was said in the court decision that advocate Azhar Siddique said IHC order was not challenged in Supreme Court.
The court after reviewing all the record declared non maintainable the petition filed in LHC because it was already filed in IHC.
The court dismisses the petition after reviewing all the arguments.
